Notice of Subsidies in the Federal Marketplace
In 2016, the federally facilitated Marketplace will begin issuing notices to employers that serve as an initial “heads-up” to the employer if any employee received a subsidy and bought coverage in the Marketplace during the current calendar year.
Final Regulations Shed Light on Wellness Programs
On May 17, 2016, the Equal Employment Opportunity Commission (EEOC) announced final regulations under the Americans with Disabilities Act (ADA) and Genetic Information Nondiscrimination Act (GINA) Title II regarding wellness programs. These regulations are similar to the proposed rules issued last year and more restrictive than the existing Health Insurance Portability and Accountability Act (HIPAA) rules. All three rules need to be carefully looked at when implementing incentive-based programs.

The State of New York is not reverting the definition of small employer to match the federal definition found in the Affordable Care Act. Rather, the State of New York will review changes to the law, if necessary, in 2018.
